1. Agreement to Terms

Welcome to Maur CRM ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website located at maur.co.ke and our CRM software services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

• "Service" refers to the Maur CRM software platform and related services
• "User" means any individual or entity using the Service
• "Account" means your registered user account
• "Content" means all data, information, and materials uploaded by users
• "Subscription" means the paid plan selected by the user

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:

• You have the legal capacity to enter into binding contracts
• You are not prohibited from using the Service under applicable laws
• You will use the Service only for lawful business purposes

4. Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Subscription and Payment

5.1 Pricing

Our Service offers three subscription tiers:

• Start-Up: KES 349/month
• Business Standard: KES 999/month
• Business Plus: KES 1,499/month

5.2 Billing

Subscriptions are billed in advance on a monthly basis. Payment is due immediately upon subscription. We accept M-Pesa, bank transfers, and other payment methods as indicated on our website.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial months.

6. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable Kenyan or international laws
• Infringe intellectual property rights
• Transmit malware, viruses, or malicious code
• Engage in unauthorized data mining or harvesting
• Send spam or unsolicited communications
• Process sensitive personal data without proper consent
• Circumvent KRA eTIMS compliance requirements

7. Data Ownership and Responsibility

You retain ownership of all data uploaded to the Service. You are solely responsible for:

• The accuracy and legality of your data
• Obtaining necessary consents for personal data processing
• Complying with Kenya Data Protection Act 2019
• Maintaining backups of your critical business data

8. Intellectual Property

The Service and its original content (excluding user data) are and will remain the exclusive property of Maur CRM. Our trademarks, logos, and trade dress may not be used without prior written permission.

9. Third-Party Integrations

Our Service integrates with third-party services including:

• M-Pesa (Safaricom)
• KRA eTIMS
• WhatsApp Business API
• Email service providers

Your use of these integrations is subject to their respective terms of service.

10. Limitation of Liability

To the maximum extent permitted by law, Maur CRM shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions due to factors beyond our control
• Accuracy of KRA eTIMS submissions (user responsibility)

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Maur CRM, its affiliates, and employees from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your failure to comply with data protection laws

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activities
• Non-payment of subscription fees
• Extended periods of inactivity

Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
